2. Applicability
These Terms & Conditions apply to all offers, orders, and agreements between Mahlako and customers who purchase products through the Mahlako website.
By placing an order through the website, the customer agrees to these Terms & Conditions.
3. Products
Mahlako offers skincare products developed with carefully selected ingredients.
Product images and descriptions on the website aim to represent the products as accurately as possible. Minor variations in color, texture, or packaging may occur and do not constitute a defect.
4. Orders
An order is considered final once the payment has been successfully completed.
Mahlako reserves the right to cancel or refuse an order in the following situations:
- suspected fraud
- incorrect pricing due to technical errors
- misuse of promotional systems such as referral codes
If an order is cancelled, the payment will be refunded.
5. Prices
All prices shown on the website are in euros (€) and include VAT unless stated otherwise. Shipping costs are calculated during checkout and displayed before payment.
Mahlako reserves the right to adjust prices at any time. Price changes do not affect orders that have already been confirmed.
6. Payment
Payments are processed securely through external payment providers.
Accepted payment methods may include:
- iDEAL
- credit and debit cards
- Apple Pay
- Google Pay
- Bancontact
- Pay by Bank
Mahlako does not store payment details.
7. Delivery
Orders are shipped within the European Union unless otherwise specified. Estimated delivery times are provided as guidance and may vary depending on the destination and shipping carrier.
Mahlako is not responsible for delays caused by shipping carriers or customs procedures.
8. Right of Withdrawal (Returns)
Customers have the right to withdraw from their purchase within 14 days after receiving the product, in accordance with EU consumer law.
However, due to hygiene and safety reasons, cosmetic products may only be returned if they are unused, unopened, and in their original packaging.
If the product has been opened or used, Mahlako reserves the right to refuse the return.
Refunds will be issued after the returned product has been received and inspected.
9. Founders Program
Mahlako may offer a limited Founders Program, allowing a restricted number of early supporters to purchase a Founder entry.
Founder entries are limited in quantity and may include specific benefits such as:
- lifetime discount on Mahlako products
- invitations to founder-related events
- milestone rewards or shop credit
- a personal founder number
- early access to product launches
Founder benefits are tied to the customer account used during the purchase and cannot be transferred without permission from Mahlako.
Mahlako reserves the right to modify or discontinue the Founders Program if necessary for operational or legal reasons.
10. Referral Program
Mahlako may provide customers with a personal referral code that can be shared with others.
Referral programs may provide benefits such as shop credit for both the referrer and the referred customer.
The following rules apply:
- each customer may use a referral code only once
- referral codes cannot be used for self-referral
- misuse or manipulation of the referral system may result in cancellation of rewards
- referral rewards may be limited annually or per account
Mahlako reserves the right to modify, pause, or terminate the referral program at any time.
11. Shop Credit (eWallet)
Mahlako may provide shop credit through promotions, referrals, or milestone rewards.
Shop credit:
- is linked to the customer account
- cannot be exchanged for cash
- cannot be transferred to other users
- may have an expiration period depending on the promotion
Mahlako reserves the right to adjust or revoke shop credit in case of misuse.
12. Liability
Mahlako is not liable for:
- misuse of products
- allergic reactions caused by ingredients
- indirect damages resulting from product use
Customers are responsible for checking product ingredients if they have known allergies or sensitivities.
13. Intellectual Property
All content on the Mahlako website including:
- text
- images
- branding
- logo
remains the intellectual property of Mahlako.
It may not be copied, distributed, or used without written permission.
14. Privacy
Customer data is processed in accordance with the Mahlako Privacy Policy. Personal information is only used for order processing, customer service, and communication related to the Mahlako services.
15. Governing Law
These Terms & Conditions are governed by the laws of the Netherlands.
However, if the customer is a consumer residing in another country within the European Union, the mandatory consumer protection laws of the customer’s country of residence will also apply where required by law.
Any disputes shall be submitted to the competent courts of the Netherlands, unless mandatory consumer law requires otherwise.
16. Changes
Mahlako reserves the right to update these Terms & Conditions at any time. The version applicable to the order is the version published on the website at the time the order was placed.
